CHAPTER Bfc 100  ORGANIZATIONAL RULES

 

PART Bfc 101  PURPOSE

 

          Bfc 101.01  Purpose.  The purpose of these rules is to establish the procedures under which the New Hampshire state board of fire control shall operate.

PART Bfc 102  DEFINITIONS

 

          Bfc 102.01  "Board" means the New Hampshire state board of fire control established as the state advisory board of fire control in RSA 153:2 and also known as the board of fire control in 153:5, I.

          Bfc 102.02  "Commissioner" means the commissioner of the New Hampshire department of safety.

          Bfc 102.03  "Department" means the New Hampshire department of safety.

          Bfc 102.04  "Person" means an individual, natural person.

          Bfc 102.05  “State fire marshal” means the state fire marshal of the state of New Hampshire.

PART Bfc 103  DESCRIPTION

 

          Bfc 103.01  Composition of Board.

 

          (a)  Pursuant to RSA 153:2, the board shall consist of 11 members, appointed by the governor, with the advice and consent of the council, for a term specified by law.

 

          (b)  One member shall be designated chair by the governor.

 

          (c) The board shall elect a vice-chair at its annual meeting.

 

          (d)  The chair shall preside over all meetings of the board.

 

          (e)  In the absence of the chair at a meeting of the board, the vice chair shall preside.

          Bfc 103.02  Duties of the Board.

 

          (a)  The responsibilities of the board include:

 

(1)  Adopting jointly with the state fire marshal, and with the approval of the commissioner, pursuant to RSA 153:5, I, amendments to the state fire code described in RSA 153:1, VI-a;

 

(2)  Adopting rules pursuant to RSA 541-A relative to procedures of the board’s operation;

 

(3)  Reviewing and assessing the application of the state fire code and recommending legislation to modify the requirements of the state fire code; and

 

(4)  Acting in a continuing advisory capacity to the state fire marshal on any matters pertaining to his/her duties pursuant to RSA 153.

PART Bfc 104  REQUESTS FOR INFORMATION

 

          Bfc 104.01  Requests for Information.

 

          (a)  All requests for information shall be directed in writing to the board and mailed to:

Concord, NH  03305.

 

          The board’s location is at 110 Smokey Bear Boulevard, Concord, NH.

 

          (b)  Public records, not otherwise declared confidential by law, may be inspected and copied at the location stated in (a) above during regular business hours.

 

          (c)  Persons desiring copies of public records shall pay the actual cost of the copies, as provided in RSA 91-A:4, IV.

PART Bfc 105  MEETINGS, DELIBERATIONS, AND DECISIONS

 

          Bfc 105.01  Meetings.

 

          (a)  The board shall meet 4 times per year and at such additional times as shall be called for by the chair or by vote of the board. 

 

          (b)  The board shall hold an annual meeting in March of each year for the purpose of electing a vice-chair.

          Bfc 105.02  Necessary Quorum.  A quorum shall be required to meet for the purpose of discussion, receiving information, conducting a hearing or taking final board actions.  A quorum shall be a minimum of 50% of the sitting board members plus one. In the event of a tie vote, the chair shall cast the deciding vote.

PART Bfc 106  APPOINTMENT OF COMMITTEES

 

          Bfc 106.01  Committees.

 

          (a)  The board shall delegate investigatory and other functions within its jurisdiction to committees consisting of one or more board members when such delegations are necessary to perform the board's work more efficiently.

 

          (b)  Committees shall make recommendations to the board, but shall not take final action on behalf of the board.

 

          (c)  Committees shall not retain paid advisors or consultants unless expressly authorized to do so by the board.
