YOUTH DEVELOPMENT CENTER

 

NOTE:

 

        Pursuant to 1981, 539:3, effective 6-30-81, the Board of Trustees of the Youth Development Center in Manchester, N.H. was granted rulemaking authority under RSA 621:35 relative to the administration of the Center.  No rules were ever filed.

 

        Pursuant to 1983, 416:19, effective 7-1-83, rulemaking authority was transferred to the Commissioner of the Department of Health and Welfare (renamed the Department of Health and Human Services pursuant to 1983, 291:1, effective 7-1-85).  See the filing index for the Department of Health and Human Services, Commissioner, for filings after 7-1-83 under rules numbered He-C.

 

        No rules were ever filed by the Department of Health and Human Services relative to the administration of the Youth Development Center.  Pursuant to RSA 621:35, the Commissioner of the Department of Health and Human Services "shall adopt rules, pursuant to RSA 541-A, relative to the proper administration of the center.  Those rules pertaining only to children committed or detained at the center or to employees shall be exempt from the notice and hearing requirements of RSA 541-A".

 

YOUTH DEVELOPMENT SERVICES, DEPARTMENT OF

 

NOTE:

 

        The Department of Youth Development Services was established pursuant to 1995, 181, effective 7-1-95.  The Commissioner of the Department was granted rulemaking authority as described under RSA 621-A:4, IV, RSA 621-A:6, II, and RSA 621-A:8.

 

        The functions, powers, duties, personnel, records, property, and funds of the Youth Services Center and the Youth Development Center were transferred to the Department of Youth Development Services pursuant to 1995, 181:24.  However, rulemaking authority of the Commissioner of the Department of Health and Human Services relative to the Youth Development Center under RSA 621:35 was not affected by 1995, 181.  See filing history for the Department of Health and Human Services, Commissioner, for filings (under rules numbered He-C) governing the Youth Development Center pursuant to RSA 621:35.

NOTE:

 

        The rulemaking authority of the Commissioner of the Department of Health and Human Services in RSA 621:35 was repealed by 1999, 219:17, II, effective 7-6-99.

 

NOTE:

 

            The Department of Youth Development Services (DYDS) was abolished pursuant to the repeal of RSA 621-A:2 by 2001, 286:21, effective 9-14-01.  Pursuant to 2001, 286:1, all “functions, powers, duties, personnel, records, property, and funds” of the DYDS were transferred to the Department of Health and Human Services (DHHS), whose Commissioner was required to establish a unit of juvenile justice services in the DHHS.

 

            No legislative provision in 2001, 286 addressed the transfer of existing rules of the former DYDS (Part Yds 501 filed under Document #6678) to the DHHS.

 

            The former rulemaking authority of the Commissioner of the DYDS under RSA 621-A:4, IV, RSA 621-A:6, II, and RSA 621-A:8 was abolished by the repeal or amendment of those statutes by 2001, 286.  Rulemaking authority was granted to the Commissioner of DHHS relative to both the Youth Development Center and the Youth Services Center under RSA 126-A:16, II-a pursuant to 2001, 286:4 and relative to the Youth Services Center under RSA 621-A:4, II pursuant to 2001, 286:13.
