AGENCY FILING HISTORIES
An agency's filing history is a chronological list of
all the adopted rules and declaratory rulings filed by the agency with the
Office of Legislative Services, Administrative Rules. A 4-digit document number assigned by the
Administrative Rules office to each filing is given with the effective
date.
Some of the agencies, as noted, have been abolished or
their rulemaking authority transferred, but their filing histories have
been retained for informational purposes.
Filing histories will be updated on the web site within a day or two
after rules are filed, but the rule itself will not be available on-line
until editing by the Administrative Rules office and the agency is
completed and the rule is certified by the agency as the same in substance
as originally filed. The document number assigned to each filing will
appear in the relevant certified rule's source note with the effective date
of the rule. See Agency
Administrative Rules for certified rules on-line.
If recently filed and effective rules are not yet certified and
therefore not on-line, the document number in the filing history will not
have an asterisk (*) next to it. The agency, the Administrative Rules
office, State Library, and the N. H. Law Library at the State Supreme Court
can provide hard copy of any effective rule not yet on-line. See Copies of the Official Version
of a Rule.
To access the filing histories, click on the underlined rule title or
subtitle prefix for the agency listed. Use an agency's filing history to
double-check an on-line rule to see if it is current. See How to Double-Check the On-Line Rule.
Filing histories for a particular agency can also be accessed through
the agency's on-line rules under Agency
Administrative Rules on the Administrative Rules home page. Once you
have a rule on screen, click on the word "Source" as it appears
at the end of any section of the rule, and the agency's filing history will
appear.
The following 3 agencies are entirely exempt from RSA
541-A, the Administrative Procedure Act, but their filing histories can be
accessed because they still must file rules with the Administrative Rules
office:
· Bfa Business Finance Authority, exempt pursuant to RSA
162-A:28, RSA 162-S:3,V, and RSA
541-A:21, I(u) and I(jj).
· HEFA
Health and Education Facilities Authority, exempt pursuant to RSA 195-D:5-a, II and RSA
541-A:21, I (v).
· HFA
(formerly Hou) Housing Finance Authority,
exempt pursuant to RSA 204-L:53 and RSA
541-A:21, I(x).
The
Community Development Finance Authority (Cdfa)
became entirely exempt from RSA 541-A on 7-29-19 pursuant to RSA 162-L:4-a
and RSA 541-A:21, I
(kk), but its filing history under RSA 541-A prior to 7-29-19 is
retained for informational purposes.
