Note On
What Is A Department Rule Filed Under RSA 541-A:
Rulemaking
authority of the Commissioner of the Department of Corrections is contained in
RSA 21-H:8, V, RSA 21-H:13, RSA 622:44, and RSA 630:5, XV along with the
authority of all agencies to adopt rules as required by RSA 541-A:16, I.
The
following statutes require Department standards or procedures, but in each case
the statute states that these standards or procedures "shall not be considered
rules subject to the provisions of RSA 541-A" and are therefore not filed
with the Office of Legislative Services:

RSA 21-H:8, III - "reasonable internal practices and procedures"
including at least the elements listed.

RSA 21-H:8, XI - Established jointly with the Commissioner of the Department of
Health and Human Services, "procedures for sharing data, at least in the
aggregate, on delinquents and offenders for purposes of correctional planning
and needs assessments."

RSA 21-H:14 - "written standards regarding the behavior and
responsibilities of inmates."
