POWERS OF THE GOVERNOR AND COUNCIL IN CERTAIN CASES

Fallen State Troopers' Memorial

Section 4:9-o

    4:9-o Committee and Special Account Established. –
I. A committee is established to select the design for a fallen state troopers' memorial, to oversee the construction of the memorial, to privately raise all of the funds necessary for its construction and maintenance, and to expend for those purposes the funds which are raised. The governor is authorized to accept for the committee, in the name of the state, the gifts of money which are donated for purposes of the memorial.
II. The gifts of money donated to construct and maintain the memorial shall be placed in a special, nonlapsing account in the state treasury, to be expended for the purposes of the fallen state troopers' memorial. Any money remaining after construction of the memorial is completed shall be used for the care, maintenance, and repair of, and additions to, the memorial, or for any other relevant purpose deemed appropriate by the committee.
III. The committee shall remain in existence upon completion of the memorial for the purposes of funding any future changes, repairs, or improvements to the memorial including addition of additional names and regular ongoing maintenance of the memorial and site.
IV. The members of the fallen state troopers' memorial committee shall be as follows:
(a) One member appointed by the New Hampshire Troopers Association of the rank of sergeant or below, from the ranks of the New Hampshire state troopers, appointed by that association.
(b) One member appointed by the New Hampshire Troopers Association from the ranks of the New Hampshire Troopers Association command staff, appointed by that association.
(c) One member of the New Hampshire State Police Benevolent Association, appointed by that association.
(d) One sworn law enforcement member of the division of state police other than a trooper, appointed by the director of the division of state police.
(e) The commissioner of the department of safety, or designee.
(f) The commissioner of the department of administrative services, or designee.
(g) One member who is a family member of a state trooper, appointed by the director of the division of state police.
V. The members of the committee shall serve at the pleasure of the appointing authority and shall elect a chairperson from among the members. The first meeting shall be called by the commissioner of safety. Four members of the committee shall constitute a quorum.
VI. The committee shall:
(a) Select the design and siting for the fallen state troopers' memorial.
(b) Oversee the construction of the memorial. The final design for the construction of the memorial shall be subject to the approval of the governor and council.
(c) Advise and inform the city manager of the city of Concord or designee relative to the design and construction plans for the memorial.
(d) Inform the long range capital planning and utilization committee established in RSA 17-M regarding the plans for the memorial.
(e) Privately raise, through and in collaboration with the New Hampshire Troopers Association, the money necessary for the planning, design, construction, and maintenance of the fallen state troopers' memorial, and shall have the authority without the approval of the governor and council, to expend the money which is raised.
