STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT to limit application fees charged to prospective residential tenants.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Prohibited Practices and Security Deposits; Rental Application Fees.  Amend RSA 540-A:3 by inserting after paragraph VII the following new paragraph:

VIII.  No landlord shall charge a rental application fee in excess of $35 or the cost of conducting a background check of the prospective tenant, whichever is less.  Any other fee charged by the landlord as part of the rental application process shall be refundable, shall not exceed $250, and shall be either refunded or credited toward the security deposit, at the tenant's discretion.

2  Effective Date.  This act shall take effect January 1, 2024.
