This bill provides that state construction contracts include a requirement that hazardous waste be separated from construction and demolition debris at the construction site, prior to transport to a recycling facility.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to disposal of construction and demolition debris from state construction projects.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Public Works Design and Construction; Disposal of Construction and Demolition Debris.  The section heading of RSA 21-I:81-a is repealed and reenacted to read as follows:

21-I:81-a  Requirements for State Construction Contracts; Listing of Subcontractor Bids; Disposal of Construction and Demolition Debris.

2  New Paragraph; Requirements for State Construction Contracts.  Amend RSA 21-I:81-a by inserting after paragraph II the following new paragraph:

III.  The contract shall include a requirement that all hazardous material be separated from construction and demolition debris at the construction site, prior to transport to the approved facility.  For purposes of this paragraph, "construction and demolition debris" shall have the same meaning as in RSA 149-M:4, IV-a.

3  Effective Date.  This act shall take effect 60 days after its passage.
