STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to the removal of a voter from the checklist.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Removal from Checklist.  Amend RSA 654 by inserting after section 44 the following new section:

654:44-a  Removal from Checklist.  Any voter who wishes to have their name removed from the checklist in the town or city where they are registered to vote may file a sworn affidavit with the town or city clerk in that municipality.  The affidavit shall contain the voter's name, domicile address, and date of birth as listed on the checklist and shall be signed by the voter under penalty of voting fraud if false information is provided.

I.  The signing of the affidavit by the voter shall be witnessed by an election official from the town or city.  The election official shall sign the affidavit affirming that they witnessed the voter signing the affidavit.

II.  The voter shall present a valid photo identification to the election official.  The election official shall examine the photo identification and confirm that the name, domicile address, and date of birth match the information provided on the affidavit.

III.  The town or city clerk shall forward the affidavit and a notice of its filing to the supervisors of the checklist.  Upon receiving such notice, the supervisors shall verify the information matches the voter's record on the checklist.  If the information matches, the supervisors shall remove the voter's name from the checklist.

IV.  The town or city clerk shall retain the affidavit and notice to the supervisors in accordance with RSA 33-A:3.  The supervisors shall retain the notice in accordance with RSA 33-A:3.

2  Removal of Names; Notice; Reference Added.  Amend RSA 654:44, II to read as follows:

II.  The provisions of this section do not apply to: the removal of the names of persons for whom the supervisors have received a report of transfer or death as provided in RSA 654:36, 654:37, or 654:37-a, [nor to] the removal of names during the period for verification of the checklist as provided in RSA 654:38 or 654:39, the removal of a name upon request pursuant to RSA 654:44-a, nor to the removal of names of persons for whom they have received a notice from a duly authorized board of registration from a community outside New Hampshire stating that a person whose name is on the checklist of the town or ward in New Hampshire has registered to vote outside New Hampshire.

3  Effective Date.  This act shall take effect 60 days after its passage.
