STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT establishing a committee to study implementing a state-based health insurance exchange.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Committee Established.  There is established a committee to study implementing a state-based health insurance exchange.

2  Membership and Compensation.

I.  The members of the committee shall be as follows:

(a)  One member of the senate, appointed by the president of the senate.

(b)  Three members of the house of representatives, appointed by the speaker of the house of representatives.

II.  Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

3  Duties.  

I.  The committee shall study the potential benefits of implementing a state-based health insurance exchange, including the potential for:

(a)  Increased enrollment;

(b)  Reduced premiums;

(c)  Economic benefits to the individual and group health insurance markets;

(d)  Improved access to data for health policy decisions, including data regarding demographic and enrollee benefit/plan design preferences; and

(e)  Stronger state control over health insurance reform.

II.  The committee shall also study the potential risks and liabilities of implementing a state-based health insurance exchange.

III.  In its study the committee shall consider:

(a)  The start-up costs for a state-based exchange;

(b)  Options to offset the startup costs, including the availability of federal planning grants and the ability of vendors to spread implementation costs across the life of a contract;

(c)  The history and status of the fee charged for the federal exchange;

(d)  Options for use of premium savings, including the availability of a federal match to further reduce premiums;

(e)  The history and status of the number of states using a state-based exchange, noting those states that transferred from a federal exchange to a state exchange and those states that went from a state-based exchange to a federal exchange;

(f)  The experience of states that transferred from a federal exchange to a state-based exchange;

(g)  The projected length of time to implement a state-based exchange;

(h)  Structural options for operating a state-based exchange;

(i)  Interagency communication required for a state exchange;

(j)  The ability to customize third-party state-based exchange platforms;

(k)  The ease of use of third-party state-based exchange platforms as compared to the federal exchange; and

(l)  Potential private-sector jobs created via a state-based exchange.

IV.  The committee may solicit information and testimony from any agency, entity, and individual with expertise or experience relevant to the study.

4  Chairperson; Quorum.  The members of the study committee shall elect a chairperson from among the members.  The first meeting of the committee shall be called by the first-named senate member.  The first meeting of the committee shall be held within 45 days of the effective date of this section.  Three members of the committee shall constitute a quorum.

5  Report.  The committee shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2023.

6  Effective Date.  This act shall take effect upon its passage.
