STATE OF NEW HAMPSHIRE

AN ACT relative to school records retention and disposition.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  School Boards; Records Retention and Disposition.  Amend RSA 189:29-a to read as follows:

189:29-a Records Retention and Disposition.

I. [Members of the] School [board] boards shall establish a records retention and disposition schedule for all official records of the school district.  If records are microfilmed, 2 films shall be made, properly labeled and stored in 2 different locations.  At least one copy shall be stored in a fireproof container.  Records which have been microfilmed may be retained or destroyed in accordance with the schedule determined by the members of the board.  A complete record of all records destroyed or discarded shall be maintained along with notations of the methods and dates of disposal.

II.  Paper records listed in the disposition and retention schedule may be transferred to electronic records, as defined in RSA 5:29, VI, and the original paper records may be disposed of as the school board chooses, subject to the requirements of other state or federal laws.  Such records shall be stored in portable document format/archival (PDF/A) or another file format approved by the secretary of state and the school board.

III.  Electronic school district records listed on the local disposition and retention schedule that are to be retained for 10 years or fewer may be retained solely electronically in their original format if approved by the school board.  The school district is responsible for ensuring the accessibility of the records for the retention period.  If the records retention period exceeds 10 years or the school board does not approve retention of the records solely electronically in an approved format, the records shall be transferred to paper, microfilmed, or stored in portable document format/archival (PDF/A) or another approved file format on a medium from which it is readily retrievable.

2  Effective Date.  This act shall take effect 60 days after its passage.
