ANALYSIS

 

This bill requires the physician who treats a trauma patient who later dies of their injuries to attest in writing that the patient care team followed all advanced trauma life support protocols.  The statement would become part of the medical record and would be required for organ donation eligibility.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT relative to medical records attestations for organ donation eligibility.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Uniform Anatomical Gift Act; Rights and Duties of Procurement Organization and Others; Duty of Patient Care Team; Medical Record Attestation for Organ Donation Eligibility.  Amend RSA 291-A:14, IX to read as follows:

IX.  Neither the physician who attends the decedent at death nor the physician who determines the time of the decedent's death may participate in the procedures for removing or transplanting a part from the decedent.  In cases of traumatic injury, the physician responsible for direct patient care shall attest in writing that all appropriate advanced trauma life support (ATLS) protocols were followed in an attempt to save the life of the patient.  The document, signed by the physician and 2 registered nurses on the patient care team, shall become part of the medical record and shall be required for organ donation eligibility.

2  Effective Date.  This act shall take effect 60 days after its passage.
