CHAPTER Saf-C 3900  INCIDENT COMMAND SYSTEM

PART Saf-C 3901  GENERAL ADMINISTRATION

 

          Saf-C 3901.01  Purpose.

 

          (a)  The purpose of these rules is to establish:

 

(1)  A uniform incident command system for use during off-site emergency response operations to releases of, or substantial threats of releases of, hazardous substances; and

 

(2)  Minimum competency training for incident command system (ICS) and minimum training criteria for off-site emergency responders to releases of, or substantial threats of releases of, hazardous substances.

          Saf-C 3901.02  Scope.

 

          (a)  These rules shall apply to employees, as defined in 40 CFR 311.2, who respond to a hazardous substance incident and who are subject to the federal requirements set forth in 29 CFR 1910.120(q).

 

          (b)  These rules shall not apply to:

 

(1)  Specialist employees; or

 

(2) Skilled support personnel as long as the personnel meet the definition of 29 CFR 1910.120(q)(4).

PART Saf-C 3902  DEFINITIONS.

 

          Saf-C 3902.01  "Commissioner" means the commissioner of the New Hampshire department of safety or his designee.

          Saf-C 3902.02  "Division" means the New Hampshire division of fire standards and training and emergency medical services.

          Saf-C 3902.03  "Hazardous substance" means "hazardous materials" as defined in RSA 147-B:2, VIII.

          Saf-C 3902.04  "Incident Command System" (ICS) means "Incident Command System" as defined in the Incident Command System, as published in NFA-ICS by the National Fire Academy located in Emmitsburg, Maryland, October 2005 edition.

          Saf-C 3902.05  "Off-site emergency responder" means a person engaged in the emergency response to releases of, or substantial threats of releases of, hazardous substances where the releases of, or substantial threats of release, occurs at a site other than:

 

(1)  Where the person is normally based for the purpose of response; or

 

(2)  A site owned and operated by the person.

          Saf-C 3902.06  "Specialist employee" means hazardous materials specialist as defined in 29 CFR 1910.120(q)(6)(iv).

PART Saf-C 3903  INCIDENT COMMAND SYSTEM

 

          Saf-C 3903.01  Uniform Incident Command System.  Any off-site emergency responder in the state of New Hampshire shall utilize the ICS as defined in Saf-C 3902.04.

PART Saf-C 3904  TRAINING CRITERIA FOR OFF-SITE EMERGENCY RESPONDERS

 

          Saf-C 3904.01  Minimum Training Competencies.

 

          (a)  For the purposes of this section:

 

(1)  First responder at the awareness level means a responder as defined in 3.3.4 of Chapter 3 of NFPA 472, 2008 edition;

 

(2)  First responder at the operational level means a responder as defined in 3.4.4 of Chapter 3 of NFPA 472, 2008 edition;

 

(3)  Hazardous materials technician means a responder as defined in 3.3.33 of Chapter 3 of NFPA 472, 2008 edition; and

 

(4)  Incident commander means a responder as defined in 3.3.36 of Chapter 3 of NFPA 472, 2008 edition.

 

          (b)  Off-site emergency responders shall meet the standards set forth in (d) below, at their responder level.

 

          (c)  Off-site emergency responders shall be trained to perform at one of the following levels:

 

(1)  First responder at the awareness level;

 

(2)  First responder at the operational level;

 

(3)  Hazardous materials technician level; or

 

(4)  Incident commander level.

 

          (d)  Training and competency standards shall comply with the following:

 

(1)  For the first responder at the awareness level, Chapter 4 of NFPA 472, Standard for Professional Competence of Responders to Hazardous Materials Incidents, 2008 edition;

 

(2)  For the first responder at the operational level, Chapter 5 of NFPA 472, Standard for Professional Competence of Responders to Hazardous Materials Incidents, 2008 edition;

 

(3)  For the hazardous materials technician level, Chapter 7 of NFPA 472, Standard for Professional Competence of Responders to Hazardous Materials Incidents, 2008 edition; and

 

(4)  For the incident commander level, Chapter 8 of NFPA 472, Standard for Professional Competence of Responders to Hazardous Materials Incidents, 2008 edition.

          Saf-C 3904.02  Training Providers.  Training providers who teach any of the training subjects set forth in Saf-C 3903.01 shall have successfully completed the "Train the Trainer" program for ICS, offered by the division.

PART Saf-C 3905  CERTIFICATION

 

          Saf-C 3905.01  Reciprocity.

 

          (a)  Any person who has received training in another jurisdiction may comply with the provisions of Saf-C 3904 by:

 

(1)  Providing proof of successful course completion, as set forth in (b) below; or

 

(2)  Having certification that has been accredited through the National Board on Fire Service Professional Qualification in Quincy, Massachusetts, or the International Fire Service Accreditation Congress in Stillwater, Oklahoma.

 

          (b)  Proof of successful course completion such as a course certificate, shall include the following:

 

(1)  Date of completion;

 

(2)  Name of level of competency obtained;

 

(3)  Name of instructor and training agency;

 

(4)  Name of person certified;

 

(5)  Number of practical and classroom instructional hours;

 

(6)  A statement that the course meets or exceeds the competencies established by NFPA 472 Standard for Professional Competence of Responders to Hazardous Materials Incidents, 2008 edition; and

 

(7)  Signature of training provider.

 

          (c)  A statement may be obtained from the training agency and provided separately in lieu of (b)(5) or (6), above.

 

          (d)  In the event that the training that forms the basis of a reciprocity request pursuant to (a), above was obtained in excess of 2 years prior to the request, the person shall be required to pass the final examination for the level of competency applied for, as offered by the division.
