Pari 801.04 "Authorized agent" means an
individual appointed to act on behalf of a kennel operator and whose document

to identify a greyhound which indicates the dog's sex, tattoo number, color,

contract with a licensee to provide greyhounds for a racing meet.

handles the greyhounds in the paddock and on the course.

284:15-a, to conduct racing and pari-mutuel wagering.

facility within the paddock used to temporarily house entered greyhounds prior
to their participation in a race performance.

of betting on the outcome of a race in which all bets are pooled and held by a
licensee for distribution of the total sum of the bets, less any deductions

licensee in the conduct of its racing meet, including the course, grandstand,

means the testing of a greyhound for foreign substances on the basis of:
(a)
Discovery of foreign substances in greyhounds of the same kennel; or
(b)
A report that someone has had the opportunity to administer or apply a
foreign substance to the greyhound or to make a foreign substance accessible to
the greyhound.

kennel operator employing more than one trainer, the sole trainer employed by a
kennel operator employing only one trainer, or a person so designated by the

Pari 801.65 "Veterinarian's list" means a list
maintained by the commission veterinarian of greyhounds scratched by the board
or withdrawn by the trainer of record for reasons of unfitness to race.

Pari 801.66 "Weigh-in" means use of a scale to
determine the weight of a greyhound immediately prior to placement in the
lock-out kennel.

PART Pari 802 DUTIES OF LICENSEES
Pari 802.01 General Duties. Licensees shall:
(a)
Comply with Pari 503;
(b)
Submit to the commission the names of all racing officials at the time
of their employment but no later than 60 days prior to the first day of the
racing meet;
(c)
Take such measures as are needed to maintain the security of the
greyhounds and to protect them from being injured, frightened or tampered with;
(d)
Exclude from restricted areas all persons not displaying a badge issued
pursuant to Pari 502.12 (a) or by the commission or a visitor's pass issued
pursuant to Pari 502.13;
(e)
Provide official racing programs which meet the requirements of Pari 802.03;
(f)
Maintain facilities in compliance with Pari 802.04;
(g)
Establish, in compliance with Pari 802.02, qualifying conditions for the
entry of greyhounds into purse races; and
(h)
Operate a greyhound adoption program complying with Pari 810.

Pari 802.02 Qualifying Conditions for Purse Races.
(a)
Licensees shall set the conditions for qualifying greyhounds for entry
into purse races.
(b)
The qualifying conditions shall be a set of requirements that the
greyhounds:
(1) Run a course of a specified distance in a
specified time period; or
(2) Complete the race in a specified finish
position.
(c)
Licensees shall:
(1) Notify the commission of the qualifying conditions
they have set at least 3 days before the first day of the racing meet;
(2) Keep the qualifying conditions continuously
posted on the notice board on the racing premises; and
(3) Notify the commission of any change in the qualifying
conditions.

Pari 802.03 Official Racing Program.
(a)
The official racing program shall:
(1) Be produced each day on which racing takes
place;
(2) Contain the information required by Pari
502.20(b);
(3) Contain the following information for each
race:
a. The grade of the race assigned by the racing
secretary;
b. The distance of the race;
c. The record for the distance of the race;
d. The
name of the greyhound which is the holder
of the record noted in c. above; and
e. The
date the record noted in c. above
was set; and
(4) Contain the following information for each
greyhound:
a. Name;
b. Color;
c. Sex;
d. Date of whelping;
e. Sire and dame;
f. Racing weight as established pursuant to Pari
808.08;
g. Number of starts in official races;
h. Number of times finishing first, second or
third;
i. Name of owner;
j. Name of trainer; and
k. A minimum of the 3 most recent past
performance lines.
(b)
The past performance lines required by (a) (4) k. above shall be shown
in sequential order with the last performance appearing first.
(c)
Whenever the name of a greyhound is changed, the former name as well as
the new name shall be published in each official racing program showing races
in which the greyhound is entered until after the greyhound has started 6 times
subsequent to the name change.

Pari 802.04 Greyhound Racing Facilities.
(a)
Licensees shall provide and maintain the facilities required by Pari
500.
(b)
In addition, licensees shall provide and maintain in good working order:
(1) The lure used on the course;
(2) An accurate scale for the weighing of
greyhounds; and
(3) Starting boxes.
(c)
Licensees shall also provide and maintain:
(1) A kennel compound which:
a. Is on the racing premises; and
b. Provides safe and humane housing for
greyhounds;
(2) A paddock area including a lock-out kennel;
and
(3) A test area for taking specimens of urine,
saliva, blood and other bodily substances.
(d)
The test area shall be equipped with:
(1) A walking
area that is large enough to accommodate 2 greyhounds at the same time; and
(2) Hot and cold running water.

Pari 802.05 Ejection and Exclusion. Upon the recommendation of the board or on its
own initiative the commission shall, after notice and opportunity for a
hearing, eject and exclude from the racing premises any individual licensed by
the commission who:
(a)
Is subject to pari-mutuel racing regulation in a foreign or another
domestic jurisdiction; and
(b)
Has:
(1) Been excluded from racing premises by such
jurisdiction;
(2) Been denied an occupational license by such jurisdiction; or
(3) Had his or her occupational license suspended
by such jurisdiction.

PART Pari 803 RACING OFFICIALS AND THEIR DUTIES
Pari 803.01 Greyhound
Racing Officials. The officials of a
greyhound racing meet shall be:
(a) The director of
racing;
(b) The judges;
(c) The racing secretary;
(d)
The lure
operator;
(e) The chart writer;
(f)
The announcer;
(g)
The clerk of scales;
(h)
The paddock judge;
(i)
The patrol judge;
(j)
The race starter and the race assistant starter;
(k)
The timer;
(l)
The photo finish operator;
(m)
The video operator;
(n)
The kennel master; and
(o)
The brakeman.

Pari 803.02 Duties of Racing Officials.
(a)
While serving in an official capacity a racing official shall not wager
on, or have any financial interest in, the outcome of any race or any greyhound
racing.
(b)
A racing official shall not accept, directly or indirectly, any
gratuity, reward or favor in connection with greyhound racing.
(c)
A racing official shall immediately report to the board every observed
violation of these rules and RSA 284.

Pari 803.03 Duties of The Director of Racing.
(a)
The director of racing shall have supervisory authority over kennel
operators, greyhound owners, trainers, kennel helpers, lead-outs and all racing
officials in matters not within the authority of the board.
(b)
The director of racing shall ascertain that all persons under his or her
supervision are properly trained in the discharge of their duties.
(c)
Licensees may reassign some or all of the duties of the director of
racing to the racing secretary as long as they give written notice to the
commission of the reassignment of duties.

Pari 803.04 Duties of The Racing Secretary.
(a)
The racing secretary shall keep records of all races including the
following information:
(1) The order of finish of all the greyhounds in
the race;
(2) The times achieved by all the greyhounds
finishing the race;
(3) The distances between the greyhounds at the
finish;
(4) The weights of the greyhounds at the
beginning of the race;
(5) The grade of the race;
(6) The distance of the race;
(7) The weather and course conditions; and
(8) The purse paid.
(b)
The racing secretary shall be responsible for collecting all stakes,
entry fees and arrears and depositing them with the persons responsible for
these monies.
(c)
The racing secretary shall verify that kennel operators, authorized
agents, greyhound owners and trainers possess current occupational licenses for
their respective positions.
(d)
The racing secretary shall:
(1) Report to the commission the licensee's
system for assigning grades to individual greyhounds; and
(2) Assign a grade to each greyhound pursuant to
the licensee's system.
(e)
The racing secretary shall change the assigned grade by a maximum of one
grade if the racing secretary determines, on the basis of the greyhound's
performance during any of the first 3 races run by the greyhound on the same
racing premises during the same racing meet, that the assigned grade was
inaccurate.
(f)
The racing secretary shall assign to each race the grade of the
greyhounds to run in that race and the race's distance.
(g)
The racing secretary shall receive all lists of:
(1) Entries;
(2) Scratches;
(3) Declarations; and
(4) Nominations.
(h)
The racing secretary shall select the entries to run races which are not
stakes races by taking into account:
(1) The grades of the greyhounds;
(2) The distances of the races;
(3) The recency of the last race run by each
greyhound sought to be entered;
(4) The number of greyhounds of different
ownership and kennels available to run; and
(5) The following selection rules about multiple
entries of the same ownership or kennel:
a. No trainer of record or owner shall have more
than 3 entries in any race which is not a race of maidens or a stakes race;
b. No multiple entries shall be selected until
all single entries are used; and
c. Multiple entries shall be selected without
the permission of the trainer of record and kennel operator when no single
entry is available.
(i) The racing
secretary shall randomly assign post positions for each greyhound in each race
by a drawing or a computerized drawing which:
(1) Is supervised by a designee of the
commission; and
(2) Takes place at least one day before the
running of the race.
(j) Owners, trainers
and authorized agents may be present at the drawing.
(k)
If the ownership of a greyhound is called into question, the racing
secretary shall:
(1) Carry out an investigation to determine
ownership;
(2) Accept or retain the greyhound as an entry if
the ownership is determined;
(3) Refuse entry to the greyhound or remove the
greyhound from the list of entries if the ownership is not determined; and
(4) Report to the board the results of the
investigation and the action taken by the racing secretary.
(l)
At the end of each day the racing secretary shall post in a conspicuous
place a list of races, race entries and post positions.

Pari 803.05 Duties of the Lure Operator.
(a)
The lure operator shall:
(1) Operate the lure in a smooth, uniform and
consistent manner so as not to impede the running of the race; and
(2) Ensure adequate distance between the lure and
lead greyhound.
(b)
When calculating the appropriate distance between the lead greyhound and
the lure, the lure operator shall take into account the lure's location on the
course and the prevailing weather conditions.
(c)
The lure operator shall:
(1) Determine that the lure is in good operating
condition; and
(2) Report to the board any circumstance that
might prevent the normal operation of the lure.

Pari 803.06 Duties of the Chart Writer. The chart writer shall compile:
(a) The following
information for each race:
(1) The date and time of the race;
(2) The distance of the race;
(3) The condition of the course;
(4) The number of the race within the race
performance;
(5) The grade of the race; and
(6) The distance between the contestants at the
finish; and
(b) The following
information for each greyhound in a race:
(1) The greyhound's post position;
(2) The greyhound's position in the race at each
pole;
(3) The greyhound's finish position;
(4) The time the greyhound took to finish the
race; and
(5) A short description of the greyhound's
running as observed by the chart writer.

Pari 803.07 Duties of the
(a)
Weigh in the greyhounds before they enter the lock-out kennel;
(b)
Weigh out the greyhounds after they exit the lock-out kennel;
(c)
Record the weight-in and weigh-out weights;
(d)
Ensure that all greyhounds are weighed in and out in a uniform manner;
(e)
Promptly report to the announcer for public announcement the weigh-out
weight; and
(f)
Periodically test the accuracy of the scale by using a known weight.

Pari 803.08 Duties of the Paddock Judge.
(a)
Before the first purse or official schooling race run by a greyhound,
the paddock judge shall:
(1) Confirm the identity of the greyhound by matching
the greyhound's appearance and tattoos to the NGA registration certificate; and
(2) Create a Bertillon card for the greyhound.
(b)
After the first purse or official schooling race run by a greyhound, the
paddock judge shall confirm the identity of the greyhound by matching the
greyhound's appearance and tattoos against the Bertillon card.
(c)
The paddock judge shall exclude from a race any greyhound for which he
or she can not confirm its identity and report that action to the board.
(d)
The paddock judge shall issue and attach to each greyhound's collar
before the greyhound is weighed in an identification tag showing:
(1) The number of the race in which the greyhound is
entered; and
(2) The greyhound's post position.
(e)
The paddock judge shall ensure that the identification tag is not
removed until the greyhound has been weighed out and covered with a numbered
blanket.
(f) The paddock
judge shall assign lead-outs to greyhounds.
(g)
The paddock judge shall ensure that anyone presenting a greyhound to be
weighed in has in his or her possession a valid occupational license.
(h)
The paddock judge shall ensure that:
(1) Only the following shall be in or near the
lock-out kennel after the greyhounds have been placed in the kennel:
a. The paddock judge;
b. The kennel master;
c. Any judge;
d. Any lead-out; and
e. Individuals authorized by the commission;
(2) No fewer than 2 people are present in the lock-out
kennel at any given time; and
(3) Each greyhound is properly fitted with a
muzzle and a numbered blanket prior to its leaving the paddock for the starting
box.

Pari 803.09 Duties of the Patrol Judge.
(a)
The patrol judge shall:
(1) Supervise the lead-outs;
(2) Inspect, either in the view of the board or
the race starter, the muzzles and numbered blankets of the greyhounds after
they have left the paddock; and
(3) Assist the race starter in his or her duties
upon the arrival of the lead-outs and greyhounds at the starting box.
(b)
In the absence of the assistant race starter, the patrol judge shall
perform the duties set forth in Pari 803.10(c).

Pari 803.10 Duties of the Race Starter and the
Assistant Race Starter.
(a)
The starter shall:
(1) Inspect the starting box for proper operation
and cleanliness;
(2) Ensure that the greyhounds are properly
muzzled and blanketed;
(3) Place the greyhounds in the starting box; and
(4) Notify the board if the starting box does not
operate properly.
(b)
The assistant race starter shall assist the race starter.
(c)
The assistant race starter shall:
(1) Rapidly pass along the length of the starting
box at the beginning of the race and remove any greyhound remaining in the
starting box; and
(2) Promptly secure the removed greyhound behind
the starting box until the race has been completed.

Pari 803.11 Duties of the Timer.
(a)
The timer shall time the race from the opening of the door of the
starting box to its finish.
(b)
The timer shall use a back-up device to time the race if the main timing
device does not
function
properly.

When the timer uses a back-up device to determine the time of the race,
the timer shall inform the board.

Use a photo finish device to record the finish of each race;

Ensure that the photo finish device is working properly; and

Pari 803.13 Duties of The Video Equipment Operator. The video equipment operator shall:
(a)
Operate all the video and audio equipment on the racing premises,
including equipment for sending and receiving video and audio signals;

Make a video tape of each race;
(c)
Ensure that the video and audio equipment, including the equipment for
sending and receiving video and audio signals, is working properly; and
(d)
Report any malfunction of such equipment to the board.

Pari 804 COMMISSION VETERINARIAN AND
LEAD-OUTS
Pari 804.01 Duties
of the Commission Veterinarian.
(a) The commission
veterinarian shall:
(1) Examine each greyhound when the greyhound is
being weighed in;
(2) Report to the board any greyhound which in
his or her medical judgment is unfit to race; and
(3) View the running of the races.
(b)
The commission veterinarian shall provide first aid to any greyhound injured
from the time that the greyhound is weighed in until the time the greyhound is
returned to the care of the kennel owner or trainer.
(c)
The commission veterinarian shall authorize medications to be
administered or applied to an entered greyhound when in the veterinarian's
professional medical opinion:
(1) The greyhound's physical condition requires
the administration or application of the medication; and
(2) The medication will not affect the
greyhound's ability to run the races for which the greyhound is entered.
(d)
The veterinarian shall maintain the veterinarian's list.

Pari 804.02 Duties
of Lead-Outs.
(a) Lead-outs shall
be trained by licensees in the scope and proper performance of their duties
before working on the racing premises.
(b) Only lead-outs
shall lead greyhounds from the paddock to the starting box.
(c) During purse races
greyhounds shall be led from the paddock to the starting box by one lead-out
per greyhound.
(d) Lead-outs shall
not hold any conversation with the public or with one another in the paddock en
route to the starting box or while returning to the paddock.
(e) Lead-outs shall
be attired in clean uniforms.
(f)
When not on break in a designated break area lead-outs shall not smoke,
drink beverages other than water or eat.
(g)
No person shall work as a lead-out on racing premises where any of the
following individuals have a financial interest in the results of any race run
on the same premises:
(1) The lead-out;
(2) The spouse of the lead-out;
(3) A parent of the lead-out;
(4) A child of the lead-out; or
(5) A sibling of the lead-out.
(h)
Lead-outs shall not wager at the racing premises where they work.
(i)
Lead-outs shall promptly report to the nearest racing official or the
commission veterinarian any infirmities or physical problems they observe in
greyhounds in their care.

PART
Pari 805 THE BOARD; JUDGES
Pari 805.01 Composition and Term of the Board.
(a)
Judges shall be accredited by ARCI.
(b)
A board of 3 judges, with one judge presiding, shall be present for each
racing performance.
(c)
One judge shall be a judge selected by the commission and 2 judges shall
be selected by the licensee unless the circumstances are those described in (d)
below.
(d)
If a judge becomes temporarily unavailable to serve, the remaining
judges shall promptly:
(1) Appoint a temporary judge to replace him or
her without regard to the temporary judge's selection by the commission or the
licensee; and
(2) Report the appointment to the commission in
writing.
(e)
The board shall be reconstituted with the same or new members at the
beginning of each racing meet.
(f)
The duties of the board shall continue for the longer of the following
periods:
(1) Ten calendar days after the last day of the
racing meet; or
(2) The period of existence of any issues related
to the meet's races which are subject to determination by the board.
(g)
The commission shall send official notice to the board when all issues
described in (f)(2) above have been determined.
(h)
The judges shall enjoy free access to the racing premises for the
purpose of carrying out their duties.

Pari 805.02 Duties of the Board.
(a)
Pursuant to RSA 284:20-b the board shall:
(1) Make recommendations to the commission on
applications for occupational licenses;
(2) Fill vacancies among the racing officials as
soon as vacancies occur;
(3) Determine the order of finish pursuant to
Pari 805.05;
(4) Decide issues arising under:
a. Pari 805.05;
b. Pari 808.02;
c. Pari 808.03;
d. Pari 808.04;
e. Pari 808.05;
f. Pari 808.06 (d), (e) and (j);
g. Pari 808.07;
h. Pari 808.08;
i. Pari 808.09;
j. Pari 808.10;
k. Pari 808.11;
l. Pari 808.12; and
m. Pari 808.13;
(5) Except as specified in (b) below, decide any
issues raised by written complaints that a specified race was unfair in any
respect;
(6) Investigate and make recommendations to the
commission on issues arising under Pari 808.06 (a)-(c) and (f)-(i) and Pari
808.14; and
(7) Report to the commission as required by Pari
805.04.
(b)
The board shall not decide claims of misconduct by judges.
(c)
The board shall:
(1) Record and investigate promptly all issues
raised and written complaints submitted to it;
(2) Order a physical examination by the
commission veterinarian of any greyhound if the board's investigation would be
incomplete without the examination;
(3) Promptly report to the commission decisions
made pursuant to (a) (4) or (a) (5) above; and
(4) Promptly report to the commission the results
of investigations and recommendations made pursuant to (a) (6) above.

Pari 805.03 Decisions by the Board.
(a)
Decisions by the board shall be in accordance with the following in the
following order:
(1) The laws of
(2) These rules; and
(3) Special conditions of the racing meet or the
race, if any have been set by the licensee.
(b)
The video and photo images of the finish of a race, while of potential
assistance to the board in its determination pursuant to Pari 805.05, shall not
be conclusive of the board's determination.
(c)
The board's determinations of the finish time of a race, the order of
finish and the finish times of individual greyhounds shall stand,
notwithstanding any malfunction of racing equipment, timing equipment or
recording equipment.
(d)
The decisions of the board shall supercede the orders of the officers of
licensees.
(e)
The decisions made, and any actions taken, by the board shall be:
(1) By a majority of the judges serving on the
board;
(2) Signed by the majority board members making
the decisions and taking the actions; and
(3) Reported to the commission as required by
Pari 805.02 (c) (3) and (4).
(f)
Decisions other than those made by the board pursuant to Pari 805.02 (a)
(4) or Pari 805. (a) (5) shall be made by the commission.
(g) Any person or
entity aggrieved by a decision of the board may challenge it through an
adjudicative proceeding complying with Pari 201.

Pari 805.04 Reporting Requirement. The board shall make a written daily report
to the commission of:
(a)
All infractions of these rules;
(b)
The decisions made, and any actions taken, by the board members
constituting the majority in the case of each decision and action of the board;
and
(c)
The decisions and actions preferred by the board member constituting the
minority in the case of each decision and action of the board.

Pari 805.05 Order of Finish.
(a)
In determining the order of finish the board shall:
(1) Consider only the relative position of the
respective muzzles of the greyhounds; and
(2) Have available the recordings produced by the
equipment described in Pari 503.08.
(b)
In the event a greyhound loses its muzzle or finishes with a hanging
muzzle, the board shall consider only the relative positions of the nose of
said greyhound and the muzzles of the other greyhounds in the race.
(c)
The board shall arrange for the display of:
(1) The order of finish in each race; and
(2) Following the display set forth in (1) above,
the sign stating "official".
(d)
Nothing in these rules shall prevent the board from correcting an error
before the display of the sign "official" or from arranging for the
sign "official" to be removed if it was displayed as a result of
error.

Pari 806.01 Occupational
Licenses Required.
(a) The following individuals
and entities shall not carry out their duties on the racing premises without
holding an occupational license issued annually by the commission pursuant to
RSA 284:18-a:
(1) Any owner;
(2) Any owner-trainer;
(3) Any trainer;
(4) Any assistant trainer;
(5) Any kennel helper;
(6) Any veterinarian;
(7) Any veterinary assistant;
(8) Any judge;
(9) Any racing secretary;
(10) Any assistant racing secretary;
(11) Any clerk to the racing secretary;
(12) Any director of racing;
(13) Any race starter;
(14) Any assistant race starter;
(15) Any announcer;
(16) Any chart writer;
(17) Any lure operator;
(18) Any brakeman;
(19) Any kennel master;
(20) Any clerk of scales;
(21) Any paddock judge;
(22) Any patrol judge;
(23) Any racing official trainee;
(24) Any photo finish operator;
(25) Any video equipment operator;
(26) Any timer;
(27) Any lead-out;
(28) Any mutuel manager;
(29) Any mutuel department employee;
(30) Any food concession manager;
(31) Any food concession employee;
(32) Any chief of security;
(33) Any security personnel;
(34) Any admissions manager;
(35) Any admissions employee;
(36) Any director of maintenance;
(37) Any maintenance employee;
(38) Any course maintenance employee;
(39) Any vendor who will be present on the racing
premises;
(40) Any totalisator company;
(41) Any employee of a totalisator company who
will be present on the racing premises; and
(42) Any employee of a licensee not otherwise
specified in (1) through (41) above.
(b)
Occupational licenses shall be valid through December 31 of the year for
which they are issued.
(c)
An applicant for occupational licensing while indicted or charged as an
adult with a felony or misdemeanor involving controlled substances or violation
of the gaming laws shall be denied a license pending the outcome of the
proceedings.
(d)
An applicant for occupational licensing who has, within the past 10
years, been convicted as an adult of a felony shall be denied a license.
(e)
An applicant for occupational licensing who has been convicted as an
adult of a misdemeanor involving controlled substances or violation of the
gaming laws shall be denied a license for 2 years from the date of the
conviction or finding.
(f)
Persons required to be occupationally licensed shall:
(1) Apply for and receive their licenses before
assuming their duties on the premises or before January first of each year, as
applicable;
(2) Submit a completed licensing application on a
form furnished by the commission; and
(3) Pay the fee specified in Pari 806.02.

Pari 806.03 Application Process for Occupational
Licensees Other Than Judges.
(a)
Each person who wishes to apply for an occupational license for any of the
positions set forth in Pari 806.01 (a) (1) through Pari 806.01 (a) (42), other
than the position of judge under Pari 806.01 (a) (8), shall do so by submitting
the following to the office of the commission located at any racing premises:
(1) A fully executed application form provided by
the commission that contains the information specified by Pari 806.05;
(2) A supplemental application form provided by
the commission that contains the information required for the specific type of
license, as set forth in Pari 806.07 through Pari 806.27;
(3) The supporting materials specified in Pari
806.29; and
(4) The license fee required by Pari 806.02,
Table 8.1.
(b) Subject to the
exceptions in (c) below, if the materials required by (a) (1) – (3) above include
a recommendation from a licensee under RSA 284: 15-a, from an occupational
licensee, or from any other third party, that recommendation shall be submitted
at the time of the submission of the application form.
(c) If the materials required by (a) (1) – (3)
above include a recommendation from a board of judges or a judge selected by the commission, the applicant may
submit his or her application form without such recommendation.
(d) An application form submitted without any
required recommendation of a board of judges or a judge selected by the
commission shall be forwarded by the commission staff to a board of judges at
the racing premises where the application was filed.
(e) Following review of the application materials
by the board of judges or the judge selected by the commission, if required by
these rules, the board of judges shall forward all application materials to the
commission, together with its recommendation on the application.
(f) Recommendations of a board of judges or of a
judge selected by the commission shall be in the form of either:
(1) A writing separate from the application
setting forth the board or judge’s recommendation as specified in Pari 806.06
(c) and (d); or
(2) The placement of a signature or of signatures
on the application form as provided in Pari 806.06 (a) – (b).
(g) Recommendations
of the board of judges or of the judge selected by the commission shall be made
within 10 days of the time an applicant submits his or her fully executed
application form, supplemental application form, licensing fee and supporting
materials.
(h) An application
form or supplemental application form shall:
(1) Be completed using a key board or legibly
printed in ink;
(2) Be signed by the applicant; and
(3) Have all sections completed or designated as
not applicable to the applicant.
(i) If the
commission, for the purpose of determining the applicant's qualifications for
licensure, requires any information or documents additional to the materials
submitted by the applicant under (a) above, it shall:
(1) So notify the applicant
in writing within 60 days; and
(2) Specify the information
or documents which the applicant is required to submit.
(j) The application
shall be denied if the applicant does not submit the additional information and
documents requested within 120 days of receipt of the request.
(k) An application
shall be considered to be on file with the commission on the first date that
the commission has received:
(1) A fully completed application form;
(2) If required by these rules, a fully completed
supplemental application form;
(3) Proof that the applicant's check has been
deposited and cleared; and
(4) All required supporting documentation,
including, if required, all recommendations from a board of judges, the judge
selected by the commission, a licensee under RSA 284: 15-a, an occupational
licensee or any other third party.
(l)
The commission shall approve or deny the application in writing within
60 days of the date that the application is on file with the commission.
(m) The application
shall be granted if the applicant has:
(1) Complied with the application process set
forth in these rules; and
(2) Meets the qualifications for the type of
licensure for which the application is made.
(n) If the application is denied, an applicant may request
a hearing to challenge the denial within 30 days from the date of the
commission’s notification of the denial.
(o) A license issued under this section shall
expire:
(1) On December 31 of the year for which the
license is issued;
(2) Upon termination of the license by the
commission;
(3) If the license is held by a corporation,
partnership or other form of association, upon change in either legal or
equitable ownership of 50 percent or more of the association from the ownership
that existed at the time that a license was initially granted to the applicant;
or
(4) If a qualification of licensure is that a
third party agree to employ an applicant, upon termination of that employment
or upon failure of the person or entity that has agreed to employ the applicant
to do so within 10 days of the issuance of the license;
(p)
If at any time during the term of a license, the information provided by
a licensee in the application form, supplemental application form, or
supporting materials becomes inaccurate, the licensee shall, within 30 days of
the time that the information becomes, inaccurate, submit a written correction
to the commission.

Pari 806.04 Temporary
Occupational Licensure.
(a) An applicant
shall be granted a temporary occupational license if the applicant for
licensure or renewal submits the following to the office of the commission
located at any racing premises prior to the date of expiration of any existing
license:
(1) A fully completed application form;
(2) A fully completed supplemental application
form;
(3) Cash, or a check drawn on an account with
sufficient funds, to cover the licensure fee; and
(4) Required supporting documentation, including
all recommendations, if required.
(b)
Temporary licensure shall expire upon the occurrence of any of the following,
whichever, occurs earlier:
(1) Action by the commission on the applicant’s
application for
licensure or renewal;
(2) The expiration of the period set forth in
Pari 806.03 (j);
(3) Notification that the applicant’s check for
the licensure will not be honored;
(4) The withdrawal of the application by the
applicant;
(5) Discovery of any matter that would disqualify
the applicant from licensure in the position sought;
(6) The revocation of temporary licensure by the
commission; or
(7) The expiration of the period of 60 days from
the date of filing of the material in 806.03 (a) above.

Pari 806.05 Application
Form for Occupational Licensees for Positions Other Than Judge. On a form provided by the commission, an
applicant for an occupational license other than that of judge under Pari
806.01 (8) shall supply the following information:
(a) The type of
license for which the applicant is applying;
(b) The year for
which the applicant is applying for a license;
(c) The applicant's
full name;
(d) The applicant’s date of birth;
(e) The applicant’s place of birth;
(f) The applicant’s social security number or, if
the applicant is not an individual, the applicant’s federal tax identification
number;
(g) The street
address of the applicant’s residence;
(h) The applicant’s residential mailing address,
if different from the street address;
(i) The telephone number of the applicant’s
residence;
(j) The applicant’s personal e-mail address;
(k) A description of the applicant, including the
applicant’s:
(1) Age;
(2) Gender;
(3) Height;
(4) Weight;
(5) Hair color; and
(6) Eye color;
(l) Whether the
applicant is married or single;
(m) Whether or not
the applicant is a citizen of the
(n) If the applicant
is not a citizen of the United States, the name of the nation in which the
individual holds citizenship and a description of the documentation possessed
by the applicant relative to his or her presence in the United States, together
with any identifying numbers assigned to that documentation;
(o) The trade name, if any, under which the
applicant proposes to conduct business;
(p) The name,
address and telephone number of the applicant’s present employer, if any;
(q) The title of the
applicant’s current job;
(r) If the applicant
is a corporation, partnership or other association, the name, title within the
association, address and telephone number of each of the applicant’s officers,
directors, trustees and owners;
(s) The street address of the applicant’s
principal place of business;
(t) The mailing
address of the applicant’s principal place of business, if different from the
street address;
(u) The applicant’s business e-mail address;
(v) The name, address, telephone number and
relationship of the applicant’s nearest living relative;
(w)
Whether or not the applicant is able to perform those duties of the
position for which he or she is applying for occupational licensure as set
forth in the rules of the commission;
(x)
Whether or not, within the past 10 years, the applicant, and any of the
applicant’s officers, directors, owners or trustees, if any, has or have been
convicted of or pleaded guilty to any felony as an adult, in any jurisdiction,
that has not been annulled;
(y)
If the answer to question (x) is yes:
(1) The name of each person or association
convicted or which pleaded guilty;
(2) A description of each felony;
(3) The date of each conviction or guilty plea;
(4) The name and location of the court where the
applicant, officer, director, owner or trustee was convicted or pleaded guilty;
and
(5) A description of each sentence imposed;
(z)
Whether or not, within the past 10 years, the applicant, and any of the applicant’s
officers, directors, owners or trustees, if any, has or have
been convicted of or pleaded guilty to violation of any law relative to gaming
or gambling or law relating to cruelty to animals, which has not been annulled;
(aa) If the answer
to (z) above is yes,
(1) The name of each person or association
convicted or which pleaded guilty;
(2) A description of each offense;
(3) The date of each conviction or guilty plea;
(4) The name and location of the court where the
applicant, officer, director, owner or trustee was convicted or pleaded guilty;
and
(5) A description of each sentence imposed;
(ab)
Whether or not, within the past 2 years, the applicant, and any of the
applicant’s officers, directors, owners or trustees, if any, has or have been
convicted of or pleaded guilty to any misdemeanor as an adult, in any
jurisdiction, that has not been annulled which involves a controlled substance;
(ac)
If the answer to question (ab) is yes:
(1) The name of each person or association
convicted or which pleaded guilty;
(2) A description of each misdemeanor;
(3) The date of each conviction or guilty plea;
(4) The name and location of each court where the
applicant, officer, director, owner or trustee was convicted or pleaded guilty;
and
(5) A description of each sentence imposed;
(ad) Whether or not
the applicant, and any of the applicant’s officers, directors, owners or
trustees, if any, is or are currently subject to the revocation or suspension
of a license or occupational license relating to pari-mutuel wagering, dog
racing or horse racing in this or any other jurisdiction;
(ae) If the answer
to question (ad) is yes:
(1) The name of each person or association so
subject;
(2) The jurisdiction in which each suspension or
revocation occurred;
(3) The date of each revocation or suspension;
and
(4) A description of the terms of each revocation
or suspension;
(af)
Whether or not the applicant, and any of the applicant’s officers,
directors, owners or trustees, if any, is or are currently not the holder of a
license or occupational license relating to pari-mutuel wagering, dog racing or
horse racing license issued in this or any other jurisdiction because such a
license or occupational license was voluntarily surrendered while a proceeding
was pending against the applicant for alleged misconduct;
(ag) If the answer
to question (af) is yes:
(1) The name of each person or association making
such a surrender;
(2) The jurisdiction in which the surrender was
made;
(3) The date of the surrender; and
(4) A description of the alleged misconduct;
(ah) Whether or not
the applicant, and any of the applicant’s officers, directors, owners or
trustees, if any, is or are currently subject to exclusion from any premises at
which the racing of horses or dogs or pari-mutuel wagering is held;

If the answer to (ah) above is yes:
(1) The name of the person or association so
subject;
(2) The jurisdiction imposing the exclusion;
(3) The date and terms of the exclusion; and
(4) The reason for such exclusion;
(aj) Whether or not the
applicant, and any of the applicant’s officers, directors, owners or trustees,
if any, is or are currently subject to a determination that he or she is
ineligible to engage in the racing or training of any horse or dog, or to
engage in pari-mutuel wagering, as the result of misconduct in this or any
other jurisdiction;
(ak) If the answer
to (aj) above is yes:
(1) The name of the person or association subject
to the determination;
(2) The jurisdiction making the determination;
(3) The date of the determination; and
(4) The reason for the determination;
(al) Whether or not
the applicant, and any of the applicant’s officers, directors, owners or
trustees, if any, has or have ever owned, operated or been associated in any
way with any illegal gambling enterprise;
(am)
Whether or not the applicant, and any of the applicant’s officers,
directors, owners or trustees, if any, has or have previously been licensed by
commission and, if so:
(1) The name of each person or association
holding a license;
(2) The type of license held; and
(3) The year or years of such licensure;
(an)
Whether or not the applicant, and any of the applicant’s officers,
directors, owners or trustees, if any, has or have previously been licensed by
an agency, commission or other authority in another state or nation that is
responsible for issuing licenses relative to pari-mutuel wagering, greyhound
racing or horse racing and, if so:
(1) The name of each person or association so
licensed;
(2) The name of each jurisdiction in which a
license was held;
(3) Each type of license held; and
