CHAPTER Gen 100 ORGANIZATIONAL RULES
Document #13554, effective 4-11-20, adopted, readopted and
renumbered, readopted with amendments and renumbered, or repealed various rules
in Chapter Gen 100. Specifically, Gen 103.02
titled “Officers”, Gen 103.06 titled “Attendance at Meetings by Members of the
Public”, Gen 103.07 titled “Notice of Meetings”, Gen 103.08 titled “Minutes of
Board Meetings”, and Part Gen 104 titled “Public Information” were
repealed. Gen 103.03 titled “Relationship
of the Board to the Office of Licensed Allied Health Professionals” was
readopted with amendments and renumbered as Gen 103.02. Gen 103.04 titled “Responsibilities of the Board”
and Gen 103.05 titled “Board Meetings and Quorum” were readopted and renumbered
as Gen 103.03 and Gen 103.04, respectively. A new Gen 103.05 titled “Other Organizational
Rules” was adopted.

replaced the prior filings for the various, former rules. The prior filings affecting the former rules
in Chapter Gen 100 included only Document #10650, effective 8-6-14.
As organizational rules the rules in Chapter Gen 100 in
Document #13554 will not expire except pursuant to RSA 541-A:17, II.

PURPOSE
Gen
101.01 Purpose. This chapter sets forth the organization and
statutory responsibilities of the genetic counselors governing board and the
manner of communication with the board.

DEFINITIONS

102.01 “ABGC” means “ABGC as defined in
RSA 326-K:1, I, namely the “American Board of Genetic Counseling”, its
equivalent, or successor.

RSA 326-K:1, II, namely the “American Board of Medical Genetics”, its
equivalent, or successor.

102.04 “Genetic counselor” means an
individual, who is licensed by the board under this chapter, to engage in the
competent practice of genetic counseling.

102.06 “Office of licensed allied health
professionals” means “office of licensed allied health professionals” as
defined in RSA 328-F:2, IV, namely, “an agency of multiple governing boards in
professions of the allied health field.”

102.07 “Practice of genetic counseling”
means, for the purposes of advising an individual client, a client’s family, or
other licensed health care professionals:
(a) Obtaining and evaluating individual, family,
and medical histories to determine genetic risk for genetic or medical
conditions and diseases in a patient, his or her offspring, and other family members;
(b) Discussing the features, natural history,
means of diagnosis, genetic and environmental factors, and management of risk
for genetic or medical conditions and diseases;
(c) Identifying and coordinating genetic
laboratory tests and other diagnostic studies as appropriate for the genetic assessment;
(d) Integrating genetic laboratory test results
and other diagnostic studies with personal and family medical history to assess
and communicate risk factors for genetic or medical conditions and diseases;
(e) Explaining the clinical implications of
genetic laboratory tests and other diagnostic studies and their results;
(f) Evaluating the client’s or family’s responses
to the condition or risk of recurrence and provide client-centered counseling and
anticipatory guidance; and
(g) Providing written documentation of medical,
genetic, and counseling information for families and health care professionals.

Board to the Office of Licensed Allied Health Professionals. Pursuant to RSA 328-F:3, II, the chairperson
of the board or the appointee of the chairperson is a member of the board of
directors of the office of licensed allied health professionals.

Gen 103.03 Responsibilities of
the Board. The board has the
responsibility to:
(a)
Fully and conditionally license genetic counselors;
(b)
Provisionally license people to practice genetic counseling and regulate
their practice;
(c)
Renew and reinstate the licenses of genetic counselors;
(d)
Regulate the profession of genetic counseling; and
(e)
Investigate complaints of misconduct by licensees and take appropriate
disciplinary action.

Gen 103.04 Board Meetings and
Quorum.
(a)
Pursuant to RSA 328-F:8 the board meets monthly or more often as its
business requires.

A majority of the board constitutes a quorum.
