PROFESSIONAL
LICENSURE AND CERTIFICATION, OFFICE OF
NOTE:
Pursuant to 2015, 276:90, 93, 103, 104,
and 107, effective 7-1-15, rulemaking authority governing certain professions
was transferred to the Executive Director of the Office of Professional Licensure
and Certification (OPLC) from the Commissioner of the Department of Health and
Human Services. The existing rules in
these areas were also transferred pursuant to 2015, 276:45 under RSA 310-A:1-a,
II and III.
Pursuant to 2017, 144:4, effective 8-15-17,
which amended RSA 314-A:6, rulemaking authority on body art licenses was also
transferred to the Executive Director of the OPLC from the Commissioner of the
Department of Health and Human Services, although administration of the rules
on body art licenses had already been transferred under RSA 310-A:1-a, II and
III.

rules will eventually be renumbered as rules of the Office of Professional
Licensure and Certification under the title “Plc.”

Pursuant
to 2022, 72:10 and 72:15, effective 7-19-22, the Governing Board of Respiratory
Care Practitioners was renamed and re-established as the Advisory Board of Respiratory
Care Practitioners under RSA 326-E:1, I and RSA 326-E:5. The former rulemaking authority of the Governing
Board of Respiratory Care Practitioners was transferred to the Executive
Director of the Office of Professional Licensure and Certification under RSA 326-E:2. Existing rules numbered “Resp” for the former
Governing Board of Respiratory Care Practitioners will eventually be repealed by
the Executive Director and renumbered as “Plc” rules.
Pursuant to 2022, 104:1 and 104:4, effective
7-26-22, the Board of Medical Imaging and Radiation Therapy was renamed and
re-established as the Advisory Board of Medical Imaging and Radiation Therapy under RSA 328-J:7, I and RSA 328-J:3. The former rulemaking authority of the Board of
Medical Imaging and Radiation Therapy was transferred to the Executive Director
of the Office of Professional Licensure and Certification under RSA 328-J:7. Document #13431 below was adopted by the
Executive Director after the rulemaking authority was transferred. Existing rules numbered “Mirt” for the former
Board of Medical Imaging and Radiation Therapy will eventually be repealed by
the Executive Director and renumbered as “Plc” rules.

RSA 332-G:14, IV. Concerning whether RSA
310:6, V on temporary licensure may be applied retroactively as a remedial statute
by the Office of Professional Licensure and Certification (OPLC) to extend the Petitioner’s
temporary license to practice medicine, which was issued by the OPLC prior to
July 1, 2023 under the former RSA 310-A:1-f, and whose temporary license expired
4 days before a full license was granted, also prior to July 1, 2023, by the
