STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to establishing an educator certification fund for fees paid to the department of education.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  State Board of Education; Fees and Educator Certification Fund..  Amend RSA 186:11, X(b) to read as follows:

(b)(1)  Fees to be paid to the commissioner of education for the administration of proficiency exams and other competence evaluations and other related fees including, but not limited to, fees for late filing and duplicate credentials, and for the issuance of educational credentials, and for the processing of criminal history record checks. These fees must bear a reasonable relationship to the actual costs related to such activities. Funds collected from these fees shall be expended only for purposes of fulfilling the requirements of this paragraph. No portion of the funds collected from these fees shall lapse, nor be used for any other purpose than fulfilling the requirements of this paragraph, nor be transferred to any other appropriation.

(2)  There is hereby established in the state treasury the educator certification fund, to be administered by the state board of education. The fund shall be nonlapsing and continually appropriated to the state board of education for the purposes established in this chapter.  All fees described in subparagraph (1) collected by the board relative to the certification of educators shall be deposited into the fund.

2  New Subparagraph; Application of Receipts; Educator Certification Fund.  Amend RSA 6:12 by inserting after subparagraph (394) the following new subparagraph:

(395)  Moneys deposited in the educator certification fund as established in RSA 186:11, X(b)(2).

3  Effective Date.  This act shall take effect July 1, 2024.
