STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to enrollment in public schools by children of school district employees.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Parental Choice; Admission; Attendance at Open Enrollment School.  Amend RSA 194-D:2, IX to read as follows:

IX. Attendance at an open enrollment school for the purposes of transportation shall not constitute assignment under the provisions of RSA 189:6 and RSA 189:8. Pupils who reside in the school district in which the open enrollment school is located shall be provided transportation to that school by the district on the same terms and conditions as provided for in RSA 189:6 and RSA 189:8 and that transportation is provided to pupils attending other public schools within that district. However, any added costs for such transportation services shall be borne by the open enrollment school. For the purposes of open enrollment or for any non-resident pupil who is a child of a school district employee, neither the sending nor the receiving school district shall be obligated to provide transportation services for pupils attending [an open enrollment] a school outside the pupil's resident district.

2  New Paragraph; Enrollment of School District Employee Children.  Amend RSA 194-D:2 by inserting after paragraph XI the following new paragraph:

XI-a.  Non-resident employees of a school district may enroll their children in the school district in which they are employed provided there is adequate space, and no additional staff or classrooms need to be added.  If the employee terminates employment with the school district, the pupil may complete the remainder of the academic year and return to the school district in which the pupil resides.

3  Funding.  Amend RSA 194-D:5, I to read as follows:

I.  There shall be no tuition charge for any pupil attending an open enrollment school located in that pupil's resident district.  For an open enrollment school authorized by the school district, the pupil's resident district shall pay to such school an amount equal to not less than 80 percent of that district's average cost per pupil as determined by the department of education using the most recent available data as reported by the district to the department.  For any non-resident pupil who is the child of a school district employee, the cost to the parents or guardians will be by payroll deduction or as per district policy.

4  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill, assumed effective for the 2024-2025 school year, would amend the pre-existing open enrollment school law, RSA 194-D:2, to allow for a non-resident student who is a child of a school district employee to attend an open enrollment school.  Such attendance is contingent upon there being adequate space and no additional staff or classrooms need to be added. The Department of Education states any fiscal impact from this bill would be at the local school district level and would vary from district to district, based on occurrence.
