STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to occupational license reciprocity.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Office of Professional Licensure and Certification; Reciprocity Licensing Process.  Amend RSA 310:17 to read as follows:

310:17 License Reciprocity.

I. Notwithstanding any other state law to the contrary, the office shall issue licenses to professionals who present evidence of an active license in good standing from another jurisdiction, in accordance with rules adopted by the executive director under RSA 541-A[, provided that the jurisdiction's licensing requirements are substantially similar to New Hampshire's licensing requirements, as determined by the executive director in consultation with the boards, commissions, and councils within the office]. Individuals seeking a license by endorsement pursuant to this section shall be required to undergo criminal history records check if otherwise required for initial licensing applications for that profession.

II. All individuals licensed under this section shall be subject to the jurisdiction of the state licensing body for that profession.

2  Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill removes the requirement for licensing requirements to be substantially similar to those of New Hampshire’s for purposes of issuing licenses to applicants licensed in another jurisdiction.

 

The Office of Professional Licensure and Certification (OPLC) states they are unable to determine if or how many additional license fees would be collected based on the change in statute.   Currently, the license fee is $155 so even one new license fee collected would result in an increase in revenue.  The OPLC states any expenditures associated with this bill can be  managed within their operating budget.

 

It is assumed fiscal impact of this bill would not occur until FY 2025.
